Welcome to RideShot, an online platform and digital marketplace for automotive photographers and videographers to showcase, share, and sell their content through personalized digital storefronts. By accessing or using RideShot (the “Platform”, “we”, “our”, or “us”), you agree to comply with and be bound by the following Terms of Service (the “Terms”). If you do not agree to these Terms, please do not use the Platform.
1. Eligibility
To use RideShot:
You must be at least 13 years of age or the minimum legal age in your jurisdiction.
If you are under the age of majority in your country, you must have parental or guardian consent to use the Platform.
You must have the legal authority to enter into this agreement on behalf of yourself or the entity you represent.
2. Account Registration
You must create an account to use certain features of the Platform.
You agree to provide accurate, current, and complete information.
You are responsible for maintaining the confidentiality of your account and password.
You are solely responsible for all activities that occur under your account.
RideShot reserves the right to suspend or terminate your account at any time for violation of these Terms.
3. User Conduct
You agree that you will not:
Use the Platform for any illegal or unauthorized purpose.
Upload, post, or share content that is unlawful, harmful, threatening, abusive, harassing, defamatory, sexual, vulgar, obscene, hateful, or racially, ethnically or otherwise objectionable.
Infringe the intellectual property rights or privacy rights of others.
Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Platform.
Use bots, scrapers, or other automated methods to access the Platform without authorization.
4. Content and Intellectual Property Rights
4.1 Ownership of Content
As a creator/seller, you retain full ownership of your original photographs and videos uploaded to RideShot.
By uploading content, you grant RideShot a non-exclusive, worldwide, royalty-free license to host, display, distribute, and promote your content solely within the context of the Platform and its services.
4.2 Copyright Infringement
You are solely responsible for ensuring you have all necessary rights, licenses, and permissions for the content you upload and sell.
By uploading content, you represent and warrant that it does not infringe any copyright, trademark, privacy, publicity, or other legal rights of any third party.
RideShot is not liable for any copyright infringement or intellectual property violations by its users.
Violation of intellectual property laws may result in immediate account suspension or termination, removal of infringing content, and referral to appropriate legal authorities.
You agree to indemnify and hold RideShot harmless from any claims arising out of or related to your content.
5. Selling on RideShot
Creators can monetize their work by offering it for sale via their personalized storefronts.
You are responsible for setting prices and managing your storefront. RideShot will manage fulfillment of digital goods purchased on your storefront.
You agree to comply with all applicable local, national, and international laws regarding digital goods, sales, and taxation.
6. Payments and Fees
RideShot uses third-party payment processor Stripe to handle transactions. Stripe will issue tax documents and manage business details. Please note, RideShot does not store sensitive info collected by Stripe.
You agree to comply with the terms of use and privacy policies of these Stripe.
Fees, commissions, and payout schedules are clearly outlined in your seller dashboard and are subject to change.
RideShot may withhold payments, freeze accounts, or reverse transactions in the event of fraud, chargebacks, or violation of these Terms.
7. Privacy and Cookies
- Our privacy policy outlines how we collect, use, and protect your personal data.
Cookies are used strictly for authentication, security, session continuity, and platform functionality. We do not sell or monetize user data.
By using RideShot, you consent to our use of cookies and data practices in compliance with GDPR, CCPA, and other global privacy laws.
8. Termination
RideShot reserves the right to suspend or terminate your account at any time and for any reason, including breach of these Terms or suspected fraud or abuse.
Upon termination, your access to the Platform will be revoked. As a Creator/Seller, previous purchases for your content will not be revoked and licenses will be upheld for the lifetime of the purchaser's RideShot account.
8. Termination
The Platform is provided “as-is” and “as-available” without warranties of any kind.
RideShot does not guarantee uninterrupted or error-free service.
We do not guarantee the accuracy, completeness, or quality of content uploaded by users.
To the maximum extent permitted by law, RideShot shall not be liable for any indirect, incidental, special, or consequential damages.
10. Indemnification
You agree to indemnify, defend, and hold harmless RideShot and its affiliates, officers, agents, employees, and partners from any claim or demand, including legal fees, arising out of:
Your use of the Platform;
Your violation of these Terms;
Your violation of any rights of another (including intellectual property rights);
Any content you upload or sell on the Platform.
11. DMCA and Copyright Complaints (for U.S. users)
If you believe your copyrighted work has been used on RideShot without permission, please send a DMCA notice to our designated copyright agent at copyright@rideshot.com.
Your notice must include:
A description of the copyrighted work;
The URL or identification of the infringing material;
Your contact information;
A statement under penalty of perjury that the use is unauthorized;
Your electronic or physical signature.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Tennessee, USA.
For users outside of this jurisdiction, local consumer protections may still apply.
Any disputes arising from these Terms shall be resolved through binding arbitration or small claims court, where applicable.
13. Changes to the Terms
We may update these Terms from time to time. The latest version will always be available on our website.
Continued use of the Platform after changes constitutes acceptance of the new Terms.
